SUMMARY:DC Carolina Law Alumni Reception
DESCRIPTION:UNC School of Law and The Law Alumni Association invite you to join us for Carolina Law Reception in D.C. with Professors Andy Hessick\, Rick Simpson\, and law students in the Supreme Court Program. \nOn November 28\, the United States Supreme Court will hear argument in McElrath v. Georgia – a case filed by the UNC School of Law Supreme Court Program. The program provides an opportunity for Carolina law students to draft briefs and assist counsel in cases before the Supreme Court. \nAt issue in the McElrath case is whether the Double Jeopardy Clause prohibits retrying a defendant on a charge following an earlier acquittal. The defendant\, Damien McElrath\, was tried for malice murder\, aggravated assault\, and felony murder after he stabbed his foster mother. The jury found McElrath not guilty of malice murder by reason of insanity but convicted him of aggravated assault and felony murder. The Georgia Supreme Court concluded that those verdicts were impermissibly repugnant because they depended on conflicting findings about McElrath’s sanity. For that reason\, the court vacated both the acquittal and convictions for retrial. \nWorking with the UNC Program\, Professor Richard Simpson ’77\, a Carolina Law alumnus and partner at Wiley Rein\, along with co-counsel Professor Andy Hessick\, represents McElrath before The Supreme Court. Their position is that double jeopardy precludes retrial of the acquittal. Brinkley. \nThis curated Festival offering will satisfy six hours of CLE\, including professional responsibility and substance abuse/mental health. \nThis premier program is $180 and includes six hours of CLE credit (pending approval)\, continental breakfast\, lunch\, and a reception with members of the Carolina Law community including faculty\, students\, alumni\, and staff. \n  \nFestival 2024 Schedule: \n8:00 – 9:00 AM Check-in and continental breakfast \n9:00 AM Opening Remarks \n9:20 – 10:20 AM “Professionalism” Standards and the First Amendment (PR) \nMary-Rose Papandrea\, Samuel Ashe Distinguished Professor of Constitutional Law\, UNC School of Law \nSoon after students at Stanford Law School disrupted Judge Kyle Duncan’s speech at a Federalist Society event in March 2023\, Dean Jenny Martinez issued an eloquent statement explaining why robust protections for the free of expression are essential for the mission of legal education. Curiously\, however\, her memo included an argument that “[l]ively\, candid\, civil\, and evidence-based discourse in disagreement is not just positive for our community\, constituted as it is in difference\, it is a professional duty.” (emphasis added) As it turns out\, when Dean Martinez wrote this statement\, the California Bar was considering the adoption of an enforceable civility standard for admitted lawyers. Such standards are common throughout the country\, although most are unenforceable. Relatedly\, lower courts have rejected First Amendment challenges to university decisions to regulate student speech that is inconsistent with the professionalism standards of the relevant discipline. This session will focus on the First Amendment concerns that civility and professionalism standards would raise for both the bar and for law schools. \nSession Materials: Endorsed Petition re Civility Rules\, Greenberg v. DESCRIPTION:Korematsu v. United States: Is My Father’s Case Still Relevant?\nIn 2018\, the Supreme Court overruled its notorious World War II decision upholding the removal of Fred Korematsu and tens of thousands of other innocent Japanese Americans from the West Coast. Or so it said. It announced this in Trump v. Hawaii\, a case upholding what the president called a “Muslim ban\,” so some remain doubtful that the danger of the Korematsu decision has truly passed. \nThis year’s Murphy Distinguished Lecture features Dr. Karen Korematsu on the continued relevance of her father’s legendary fight for his constitutional rights during one of the most challenging moments in U.S. history. His remarkable story of courage\, resilience\, and commitment to civil rights for all will echo loudly in the law school’s rotunda at a time when constitutional rights and values are once again challenged. \nAbout the speaker:\nDr. Karen Korematsu is the Founder and Executive Director of the Fred T. Korematsu Institute\nand the daughter of the late civil rights icon\, Fred Korematsu. Since her father’s passing in 2005\,\nKaren has carried on his legacy as a national public speaker and educator\, traveling throughout\nthe country advocating for civil liberties\, social justice\, civics\, and ethnic studies education.\nHer message encompasses Fred’s story\, legal history\, the relevance of his case to today’s issues\nand the promotion of Fred Korematsu Day of Civil Liberties and the Constitution on January 30th\nin perpetuity for all fifty states. \nShe has presented to K-12 schools\, colleges\, universities\, law schools\, national and state\nconferences\, including the National Judicial College\, Ninth Circuit Judicial Conference and\nthe South Carolina State Judicial Conference. She has signed on to amicus briefs in several cases\nopposing violations of constitutional rights arising after 9/11\, including Odah v. United\nStates\, Turkman v. Ashcroft\, Hedges v. Obama\, and Hassan v. City of New York and Trump v.\nHawaii. \nIn 2015\, Karen was inducted as the first non-lawyer member of the National Asian Pacific\nAmerican Bar Association. She serves on the board of directors of Advancing Justice-AAJC. She\nserves on the National Advisory Board of the Fred T. Korematsu Center for Law and Equality at\nthe University of California\, Irvine\, School of Law. \nShe has been interviewed on radio\, podcasts and TV. Her Op/Ed’s have appeared in the NY\nTimes and the Washington Post. Karen has received numerous awards and honors including\nGMNY 2015 Isidore Starr Award\, Muslim Advocates-Voice of Freedom Award\,\nthe ACLU Chief Justice Earl Warren Civil Liberties Award\, and in 2017 was a recipient of the\nKey to the City of Dearborn\, Michigan by the Mayor of Dearborn. \nKaren received her first honorary Doctorate of Humane Letters from St. Michael’s College in\nBurlington\, Vermont\, May 2019. She received her second honorary Doctorate of Humane Letters\nfrom Haverford College in Pennsylvania\, May 2022.
