SUMMARY:Watch: Media Coverage of Prosecutors and Their Elections
DESCRIPTION:  \nWatch now: Play a recording of this event. \nA recent survey found that most Americans do not know that their local prosecutor is elected.  How could that be? \nOne possible answer to that question may lie in the media coverage that prosecutors receive.  Outside of large cities\, prosecutors do not receive much media coverage\, and the coverage that they do receive rarely mentions that they are an elected office—even in an election year. \nJoin the Prosecutors and Politics Project for an important discussion about media coverage of prosecutors and their elections\, featuring journalists and prosecutors! \nPanelists include: \nMark Dupree\, Sr.\, District Attorney in Wyandotte County\, Kansas \nDupree leads an office of over 60 employees. His administration has increased the felony trial conviction rate by 27%. Dupree has successfully created the first ever “Conviction Integrity Unit” in the state of Kansas\, since re-named “Community Integrity Unit” which is responsible for ensuring that convictions obtained previously still hold integrity today and holding law enforcement accountable with the establishment of a hotline for residents to register complaints. His efforts for transforming the traditional manner in which District Attorney’s Offices have operated has been recognized nationally\, with articles featured twice in the New York Times and interviewed on the nationally syndicated Roland Martin Show. Community involvement is the bedrock of the Dupree Administration. It builds community trust\, and that trust greatly assists in crime prevention and bringing justice. Dupree and his administration lead the way in speaking at schools\, neighborhood watch meetings\, church gatherings\, and civic organizations. \nJulie Gunnigle\, Legal Director\, Arizona NORML \nGunnigle is an attorney and former prosecutor who fights for justice in our criminal legal system\, for funding in our public schools\, and for reproductive justice for our families. She was the 2020 and 2022 Democratic nominee for Maricopa County Attorney\, coming closer than any reform candidate in 40 years to taking that office. Since that time\, Gunnigle has worked as the Legal Director for Arizona NORML where she helps individuals who have been directly impacted by the war on drugs expunge their convictions and get a true second chance. \nGeorge Joseph\, Senior Reporter for The City \nJoseph is a Senior Reporter for The City with a focus on criminal justice and courts. He previously worked for WNYC and Gothamist\, and has published stories with NPR\, ProPublica\, Esquire\, and The Intercept among other outlets. \nWill Knight\, Attorney\, Maricopa County\, Arizona\n \nKnight is a directly impacted Colombian-American attorney who practices criminal defense and civil rights litigation in Phoenix\, Arizona.  Knight has a background in both prosecution and indigent defense\, and he had the privilege of defending numerous protesters against false\, politically motivated gang prosecutions during the 2020 uprising\, leading to several high profile multi-plaintiff and class action lawsuits against local police and prosecutors.  Knight ran in a crowded field for Maricopa County Attorney in 2019 and 2020 following the appointment of the previous office-holder to the Supreme Court of Arizona. \nRyan Thornburg\, Associate Professor at the UNC Hussman School of Journalism and Media \nThornburg is an associate professor at the University of North Carolina at Chapel Hill with an interest in social media\, data driven reporting and digital media economics. Before joining the school in 2007\, he spent a decade in leadership positions in online newsrooms\, mostly working on national and international news at The Washington Post.

SUMMARY:The Future of the First Amendment-2023 Wade H. Hargrove Media Law and Policy Colloquium
DESCRIPTION:On April 10\, the UNC Center for Media Law and Policy will host the 2023 Wade H. Hargrove Media Law and Policy Colloquium featuring Floyd Abrams\, Senior Counsel at Cahill Gordon & Reindel. Abrams\, one of the nation’s leading First Amendment lawyers\, will speak about “The Future of the First Amendment.” In addition to giving prepared remarks\, he will sit down with Mary-Rose Papandrea\, Samuel Ashe Distinguished Professor of Constitutional Law at the UNC School of Law\, for an extended conversation about this important topic. \nAbrams has extensive experience in high-visibility matters\, often involving First Amendment\, securities litigation\, intellectual property\, public policy and regulatory issues. He has argued frequently in the U.S. Supreme Court in cases raising issues as diverse as the scope of the First Amendment\, the interpretation of ERISA\, the nature of broadcast regulation\, the impact of copyright law\, and the continuing viability of the Miranda rule. Most recently\, he prevailed in his argument before the Supreme Court on behalf of Senator Mitch McConnell as amicus curiae\, defending the rights of corporations and unions to speak publicly about politics and elections in Citizens United v. Federal Election Commission. Abrams also represented The New York Times in the Pentagon Papers case and other important First Amendment litigation before the Supreme Court. He represented Nina Totenberg and National Public Radio in the 1992 “leak” investigation conducted by the United States Senate arising out of the confirmation hearing of Justice Clarence Thomas and\, in 2004 and 2005\, Judith Miller and Matthew Cooper in their efforts to avoid revealing their confidential sources. \nDescribed by Senator Daniel Patrick Moynihan as “the most significant First Amendment lawyer of our age\,” Abrams has been awarded with Lifetime Achievement Awards by The New York Law Journal and The American Lawyer (2013). For fifteen years\, Abrams was the William J. Brennan\, Jr. Visiting Professor of First Amendment Law at the Columbia Graduate School of Journalism. He also has been a Visiting Lecturer at Yale Law School and Columbia Law School and he is author of Friend of the Court: On the Front Lines with the First Amendment\, published by Yale University Press (2013) and Speaking Freely: Trials of the First Amendment\, published by Viking Press (2005). \nAbrams will speak at 7:30 p.m. in the Chancellors’ Ballroom at the Carolina Inn. The event is free and open to the public. \nAbout the Colloquium\nThe UNC Center for Media Law and Policy hosts the Wade H. Hargrove Media Law and Policy Colloquium\, which was established in 2009 to honor a figure of national prominence in the areas of media law or media policy. It was funded in part by the North Carolina Association of Broadcasters and North Carolina Cable Telecommunications Association to recognize the more than 30 years of service that Wade Hargrove\, a graduate of the University of North Carolina at Chapel Hill and the UNC School of Law\, provided to these organizations as well as media and technology companies throughout North Carolina and the nation. \nThe colloquium is a world-class event that draws attendees from both industry and academia. Speakers have included David Barrett\, former chairman and CEO of Hearst Television Inc.; Ben Sherwood\, former president of Disney|ABC Television; and David Cohen\, Ambassador to Canada and former senior executive vice president of Comcast Corp. Past colloquia have been televised by C-SPAN and UNC-TV.

SUMMARY:Prosecuting Cannabis: Approaches from States without Legalization
DESCRIPTION:Over the last decade\, a large number of states have adopted various forms of marijuana reform. To date\, 21 states have legalized marijuana for recreational purposes and 38 have legalized medical marijuana use. While public opinion polls suggest that the vast majority of people support marijuana legalization\, less is known about the opinions and policies of prosecuting attorneys in states that have not yet legalized marijuana for any purpose. \nJoin the Prosecutors and Politics Project at UNC School of Law and the Drug Enforcement and Policy Center at The Ohio State University Moritz College of Law for a conversation with a panel of legal experts and academics. Panelists will discuss results from a recent study of marijuana enforcement and examine how different district attorney offices approach marijuana offenses.

SUMMARY:DC Carolina Law Alumni Reception
DESCRIPTION:UNC School of Law and The Law Alumni Association invite you to join us for Carolina Law Reception in D.C. with Professors Andy Hessick\, Rick Simpson\, and law students in the Supreme Court Program. \nOn November 28\, the United States Supreme Court will hear argument in McElrath v. Georgia – a case filed by the UNC School of Law Supreme Court Program. The program provides an opportunity for Carolina law students to draft briefs and assist counsel in cases before the Supreme Court. \nAt issue in the McElrath case is whether the Double Jeopardy Clause prohibits retrying a defendant on a charge following an earlier acquittal. The defendant\, Damien McElrath\, was tried for malice murder\, aggravated assault\, and felony murder after he stabbed his foster mother. The jury found McElrath not guilty of malice murder by reason of insanity but convicted him of aggravated assault and felony murder. The Georgia Supreme Court concluded that those verdicts were impermissibly repugnant because they depended on conflicting findings about McElrath’s sanity. For that reason\, the court vacated both the acquittal and convictions for retrial. \nWorking with the UNC Program\, Professor Richard Simpson ’77\, a Carolina Law alumnus and partner at Wiley Rein\, along with co-counsel Professor Andy Hessick\, represents McElrath before The Supreme Court. Their position is that double jeopardy precludes retrial of the acquittal. The case will be argued by Professor Simpson. \nJoin us at Charlie Palmer Steak from 5:30 – 7:30 to hear from Professors Simpson and Hessick.  Remarks will begin at 6:15 p.m. \nRSVP by Monday\, November 27th\, at noon. Questions? Contact Kelly Mann Rose\, assistant director of alumni and donor relations\, at mann@unc.edu.

SUMMARY:Festival
DESCRIPTION:On February 2\, 2024\, the UNC Law Alumni Association will present Festival\, a boutique offering of CLE exclusively for Carolina Law alumni. Join us at the Carolina Club for a full day of interesting CLE taught by beloved professors\, including Dean Martin H. Brinkley. \nThis curated Festival offering will satisfy six hours of CLE\, including professional responsibility and substance abuse/mental health. \nThis premier program is $180 and includes six hours of CLE credit (pending approval)\, continental breakfast\, lunch\, and a reception with members of the Carolina Law community including faculty\, students\, alumni\, and staff. \n  \nFestival 2024 Schedule: \n8:00 – 9:00 AM Check-in and continental breakfast \n9:00 AM Opening Remarks \n9:20 – 10:20 AM “Professionalism” Standards and the First Amendment (PR) \nMary-Rose Papandrea\, Samuel Ashe Distinguished Professor of Constitutional Law\, UNC School of Law \nSoon after students at Stanford Law School disrupted Judge Kyle Duncan’s speech at a Federalist Society event in March 2023\, Dean Jenny Martinez issued an eloquent statement explaining why robust protections for the free of expression are essential for the mission of legal education. Curiously\, however\, her memo included an argument that “[l]ively\, candid\, civil\, and evidence-based discourse in disagreement is not just positive for our community\, constituted as it is in difference\, it is a professional duty.” (emphasis added) As it turns out\, when Dean Martinez wrote this statement\, the California Bar was considering the adoption of an enforceable civility standard for admitted lawyers. Such standards are common throughout the country\, although most are unenforceable. Relatedly\, lower courts have rejected First Amendment challenges to university decisions to regulate student speech that is inconsistent with the professionalism standards of the relevant discipline. This session will focus on the First Amendment concerns that civility and professionalism standards would raise for both the bar and for law schools. \nSession Materials: Endorsed Petition re Civility Rules\, Greenberg v. Lehocky\,  Mahanoy Area School District v. B. L. by and through Levy\, Next Steps on Protests and Free Speech\,  Speech First\, Inc. v. Sands\,  Tatro v. University of Minnesota \n10:20 – 10:30 AM      Break \n10:30 – 11:30 AM      The Law of Presidential Accountability \nMichael J. Gerhardt\, Burton Craige Distinguished Professor of Jurisprudence\, UNC School of Law \nProfessor Gerhardt will discuss what we know\, and do not know\, about the constitutional mechanisms for holding presidents accountable for their misconduct. These questions still dominate the news\, not just because Donald Trump is running again for president but also because the House has begun three impeachment inquiries against President Biden. He will discuss the basic law governing presidential accountability\, including impeachment\, the scope of Section 3 of the Fourteenth Amendment as a mechanism for rendering ineligible anyone running for president who has incited insurrection in violation of their constitutional oaths\, how the 25th amendment’s procedures for  temporarily suspending presidents\, whether censure is constitutional\, the procedures required in impeachment trials\, and whether there are any precedents that will help to guide the nation as it moves increasingly closer to election day and beyond. \nSession Materials: The Trump Impeachments: Lessons for the Constitution\, Presidents\, Congress\, Justice\, Lawyers\, and the Public\,  How Impeachment Works \n11:30 – 12:30 PM       Lunch \n12:40 – 1:40 PM         Hot Topics at the U.S. Supreme Court \nDavid S. Ardia\, Reef C. Ivey II Excellence Fund Term Professor of Law\, UNC School of Law and Co-Director of the Center for Media Law and Policy; Osamudia James\, Professor of Law\, UNC School of Law; Elizabeth Fisher\, Adjunct Professor\, UNC School of Law with moderator and panelist: Mary-Rose Papandrea\, Samuel Ashe Distinguished Professor of Constitutional Law\, UNC School of Law \nThis panel will discuss some of the hot topics before the U.S. Supreme Court\, including several First Amendment and social media cases\, the future of the Chevron doctrine\, and a double jeopardy case featuring Carolina Law’s Supreme Court program. \nSession Materials:  McElrath Brief for the Petitioner\, McElrath v. State of Georgia Petition for Writ of Certiorari \n1:40 – 2:40 PM          Attorney Mental Health:  General concepts\, individual experience (SA/MH) \nDavid Kouba ‘02\, Arnold & Porter \nThis engaging session will focus on attorney mental health\, including issues that frequently impact attorneys and strategies for recognizing and responding to those issues. Informed by ethical considerations and legal obligations\, the presentation will draw from David’s education\, experience\, and observations as an attorney and trained mental health counselor and attempt to make mental health issues clearer and more relatable. \nSession Materials: Attorney Mental Health: General Concepts… Individual Experiences (PPT) \n2:40 – 2:50 PM           Break \n2:50 – 3:50 PM           Generative AI in Legal Education & Law Practice \nNicole M. Downing\, Clinical Associate Professor of Law and the Assistant Director for Public Services\, Kathrine R. Everett Law Library\, UNC School of Law and Pete Nemerovski\, Clinical Associate Professor\, UNC School of Law \nProfessors Downing and Nemerovski have spent much of 2023 studying the impact of Generative AI on legal education and law practice\, and both have incorporated GenAI into their courses. In this presentation\, they will share their experiences with GenAI and their thoughts on how lawyers and law students will engage with this technology in the years to come. The topics covered will include teaching students about prompt engineering\, differences between legal and non-legal GenAI programs\, and the potential for GenAI to help lawyers better serve their clients. \nSession Materials: Generative AI in Legal Education & Practice (PPT)\, Generative Artificial Intelligence in Legal Education and Law Practice- Nemerovski Slides (PPT)\, Generative AI Exercise Handout \n3:50 – 4:00 PM          Break \n4:00 – 5:00 PM           UNC Law School: The First Century\, 1843-1939 \nMartin H. Brinkley\, Dean and William Rand Kenan\, Jr.\, Distinguished Professor of Law and Director\, UNC Law Institute for Innovation  \nThis session will chart the history of UNC Law School from its inception as an experiment in blending private and university legal education in the 1840s\, through its emergence as a “modern” law school at the opening of World War II. He will cover public resistance to Carolina’s halting efforts to adopt the reforms in legal education fostered by Harvard Law School Dean Christopher Columbus Langdell\, through the eventual triumph of the Langdellian “case method” under Dean Merton Leroy Ferson and President Harry Woodburn Chase in the early 1920s. \nSession Materials: A New Model Law School \n5:00 – 6:00 PM           Reception with law students \nSpace is limited and will be based on a first come basis.

SUMMARY:2024 Hargrove Colloquium: Media Law in the Age of Artificial Intelligence
DESCRIPTION:Join us for an exploration of the legal landscape surrounding media and artificial intelligence as we navigate the complexities of this rapidly evolving field. Come hear from David McCraw\, Deputy General Counsel at The New York Times\, and a panel of experts who will discuss the impact of generative AI on copyright law\, defamation law\, political communication\, and journalism. We’ll tackle such questions as who owns the creative output generated by AI? Who\, if anyone\, can be held liable for harmful or defamatory content that AI generates? What are the potential risks and safeguards around AI-powered misinformation and voter manipulation? How is AI transforming the news industry? \nWhether you’re a lawyer\, journalist\, media executive\, or simply curious about the intersection of AI and media\, we hope that you will join us for this thought-provoking exploration of Media Law in the Age of Artificial Intelligence. \nThis event is free and open to the public.
